These Terms govern your use of the website at gatachi.com and all related services offered by Gatachi Technologies LLC-FZ ('Gatachi', 'we', 'us', 'our'), a company incorporated and registered in the United Arab Emirates.

2. Acceptance of Terms

By accessing our website, completing a fertility assessment, purchasing any product or service, or otherwise using any part of our platform, you confirm that:

  • You are at least 18 years of age
  • You have read, understood, and agree to be bound by these Terms
  • You are located in a region where our services are available
  • You are not legally prohibited from entering into binding agreements
  • We reserve the right to modify these Terms at any time. Continued use of our services following any changes constitutes your acceptance of the updated Terms.

3. Our Services

Gatachi provides a digital fertility information and assessment platform. Our services currently include:

  • Free personalized fertility snapshot reports generated via our online assessment tool
  • Comprehensive fertility reports (where available)
  • Educational fertility content and resources
  • Facilitation of access to partner fertility clinics and healthcare providers (with your consent)
  • Blood test booking and related services through accredited laboratory partners (where available)
  • Fertility supplement recommendations and purchases (where available)

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

4. Important Medical Disclaimer

GATACHI IS NOT A MEDICAL PROVIDER AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

All content, reports, and information provided through our platform are for informational and educational purposes only. They are designed to be an indicative guide to help you better understand your reproductive health and are not a substitute for professional medical advice, diagnosis, or treatment.

Specifically:

  • Our fertility assessments and reports do not constitute a clinical diagnosis of any condition
  • Our AI-generated reports are produced by automated systems and have not been reviewed by a licensed medical professional
  • Results are based solely on the information you provide and may not reflect your complete health picture
  • You should always consult a qualified healthcare provider before making any decisions about your health, fertility treatment, or medical care
  • Gatachi is not licensed by the Dubai Health Authority (DHA) or any other UAE health regulatory authority to provide clinical services

By using our services, you acknowledge and accept that Gatachi's reports are informational tools only and that all health decisions remain your sole responsibility in consultation with qualified medical professionals.

5. AI-Generated Content

Our fertility reports are generated using artificial intelligence. By using our services you acknowledge that:

  • Reports are produced by automated AI systems based on the answers you provide
  • AI-generated content may contain inaccuracies or omissions
  • Reports are personalized to your inputs but are not individually reviewed by a human clinician before delivery
  • The accuracy of your report depends on the accuracy and completeness of the information you provide

We continuously work to improve the quality of our AI-generated reports but make no guarantee of accuracy, completeness, or suitability for any specific individual circumstance.

6. Eligibility and User Responsibilities

To use our services you must be at least 18 years of age. By submitting an assessment you confirm that you are 18 or older.

You agree to:

  • Provide accurate, complete, and truthful information in all assessments and forms
  • Use our services solely for personal, non-commercial purposes
  • Not misuse, copy, reproduce, or exploit any part of our platform or reports without our written consent
  • Not use our services for any unlawful purpose or in violation of these Terms
  • Not attempt to reverse engineer, decompile, or extract the underlying algorithms or technology of our platform

We reserve the right to suspend or terminate access to any user who violates these Terms or misuses our platform.

7. Partner Clinics, Laboratory Providers and Third-Party Services

Gatachi is not a referral service. Our platform facilitates access to partner fertility clinics and accredited laboratory providers for your convenience. Any information about partner clinics or healthcare providers provided through our platform is for informational purposes only.

Where blood testing or laboratory services are offered through our platform, these are carried out by third-party accredited medical laboratory providers. We partner only with reputable, appropriately accredited providers. Test results are provided for informational purposes and must be reviewed with a qualified healthcare professional.

We make no guarantees, endorsements, or warranties regarding any third-party clinic, laboratory provider, or healthcare service accessible through our platform. Any relationship you enter into with a clinic or healthcare provider is solely between you and that provider. Gatachi acts solely as a platform facilitating that connection and is not a party to any clinical relationship between you and any healthcare provider.

You are solely responsible for reviewing and accepting the terms and conditions of any third-party provider before engaging their services.

8. Payments, Subscriptions and Refunds

Where our services require payment, you agree to pay all applicable fees as presented at the time of purchase. Prices are subject to change at our discretion.

Certain services may be offered on a subscription or instalment basis. Details of recurring charges, cancellation rights, and payment terms will be presented clearly at the point of purchase.

Where buy-now-pay-later (BNPL) payment options are available through third-party providers, you accept the relevant third-party provider's terms upon selecting that payment method. Gatachi is not responsible for the approval, terms, or management of BNPL arrangements.

Refund eligibility depends on the specific product or service purchased. Digital reports and personalized assessments are generally non-refundable once generated. Any exceptions will be stated clearly at the point of purchase or upon request to info@gatachi.com.

9. Intellectual Property

All content on gatachi.com, including but not limited to our brand, logo, assessment framework, report formats, written content, and proprietary algorithms, is the intellectual property of Gatachi and is protected under applicable UAE and international intellectual property law.

You may download or print your personal fertility report for your own non-commercial use. You may not reproduce, distribute, modify, publish, or exploit any part of our platform, content, or reports for any commercial purpose without our prior written consent.

Any feedback, suggestions, or ideas you submit to us may be used by Gatachi freely and without obligation to you.

10. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference and available at gatachi.com/pages/privacy-policy.

By using our services, you consent to the collection and processing of your personal and health data as described in our Privacy Policy, including for the purpose of generating your personalized fertility report.

11. Limitation of Liability

To the maximum extent permitted by applicable UAE law, Gatachi and its officers, employees, agents, and subcontractors shall not be liable for:

  • Any indirect, consequential, incidental, or punitive damages arising from your use of our services
  • Any decisions made by you in reliance on information or reports provided through our platform
  • Any inaccuracies in AI-generated reports resulting from incomplete or incorrect information provided by you
  • Any actions, advice, or outcomes arising from your engagement with third-party clinics or healthcare providers
  • Any interruption, suspension, or discontinuation of our services

Our total liability to you for any claim arising from or related to these Terms or your use of our services shall not exceed the amount paid by you to Gatachi in the twelve months preceding the relevant claim, or AED 500, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Gatachi and its officers, employees, agents, and representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of our services in violation of these Terms
  • Any inaccurate or misleading information you provide through our platform
  • Your violation of any applicable law or third-party rights

13. No Insurance and Financial Responsibility

Gatachi does not accept health insurance for any of its services. All services are provided on a direct-pay basis. You are solely responsible for any fees charged by Gatachi or any partner clinic or healthcare provider you engage through our platform.

14. Third-Party Links and Content

Our platform may contain links to third-party websites, services, or content. These links are provided for convenience only. Gatachi has no control over third-party content and accepts no responsibility for it. Your use of any third-party website or service is at your own risk and subject to that party's own terms and conditions.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the federal laws of the United Arab Emirates and the laws of the Emirate of Dubai, as applicable to Gatachi Technologies LLC-FZ, a company registered in the Meydan Free Zone, Dubai.

Any dispute arising out of or in connection with these Terms, including any question relating to their existence, validity, or termination, shall first be subject to good-faith negotiation between the parties. If not resolved within 30 days, the dispute shall be referred to and finally resolved by arbitration under the rules of the Dubai International Arbitration Centre (DIAC) in Dubai, conducted in English under applicable DIAC rules with one arbitrator.

Nothing in this clause prevents either party from seeking urgent injunctive or interim relief from a competent Dubai court.

16. General Provisions

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gatachi regarding your use of our services.

Waiver: Our failure to enforce any right under these Terms shall not constitute a waiver of that right.

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. Gatachi may assign these Terms freely.

Changes: We may update the Terms from time to time. We will notify you of material changes by updating the date at the top of this page. Your continued use of our services after changes have been made constitutes your acceptance of the updated Terms.
